Survivors of domestic violence who have been pushed into debt by an abuser may soon have a clearer path to financial recovery. A newly signed bipartisan measure in Illinois aims to shield these individuals from the long-term economic fallout that often follows abuse.
The ABC7 I-Team looked into the legislation, which addresses a problem many victims face: being coerced into taking out loans, opening credit cards, or signing leases under pressure. Even after escaping the abusive situation, survivors can be held responsible for debts they never wanted or that were used to control them. This financial burden can block their ability to rent an apartment, buy a car, or secure a job, making it nearly impossible to rebuild their lives.
Under the new law, courts will have clearer guidelines to separate legitimate debts from those incurred through coercion or fraud related to domestic violence. It allows survivors to petition for relief, potentially preventing creditors from collecting on certain obligations. Supporters say the change recognizes that financial abuse is a core part of domestic violence, not just a side effect.
The measure passed with support from both parties, a rare point of unity in a divided legislature. Advocates for survivors have long pushed for such protections, arguing that without them, victims are often forced to choose between unsafe living situations and financial ruin. The law is expected to take effect next year, giving courts and legal aid groups time to prepare. While it does not erase all debts automatically, it provides a vital legal tool for those who have been trapped by economic control.
